How to help members who receive RIF notices

Urgent: Reduction In Force Rights

In the event that the district does issue Reduction In Force (RIF) letters as we approach the March 15th deadline, please take the following steps to protect your rights.

  1. If you receive a layoff notice, notify the CTA/Mt. Hamilton office immediately. The CTA Mt. Ham # is 272.0601
  2. Go to the BUSD district office and get the form time stamped. Mayra in personnel may have some forms for you to be given. There is a Request for Hearing form that must be turned in within seven calendar days.
  3. Come to the Mt. Hamilton Office where you will be given a "Notice of Dissent" form and other materials. You will be assisted in all aspects of the process.
  4. Do not agree to resign if asked to as you will lose rights by doing so!
  5. Contact CTAB Exec Board member Lina Prokopchak who will coordinate services for our members who received RIF notices.

IV. Old Business

1. RIF and Release notices---Joyce---10 min (extended) Clarifications given

When teachers get RIF notice, they need to go to District Office and get the “Request for Hearing” form time stamped. They then are to come to Mt. Hamilton with a copy of the notice to request a hearing within 7 days and they will fill out forms which are placed in a folder.

The CTA lawyer will deal with these issues. This process will make certain that a correct order for rehire is done correctly.

2. By-Laws—Joyce—5 min—Vote Motion (Peter D) to approve standing rules as submitted. Seconded by Pat Patterson (Vinci Park). Modified section P3…Motion to Pass as Modified Approved 16-0-0.

3. School Board Election---Joe---5 min Let Joe know if interested in being on School Board interview committee. 2 positions open in November. Let Joe know of any potential candidates. Need to check the timeline

4. Association Presidents Meeting in Burlingame—Joyce—3 min.: Info on meeting Joyce attended. Idea to have rallies leading up to mid-May.

5. Site Concern Update from February 12—Joyce

a. 4th/5th Conference Prep days – need to not have other district functions which block the days for prep.

b. 6th/8th grade writing assessmentà Honey Berg has not responded yet.

c. Majestic Way issue regarding teacher contact with parents and grading policyà Marc and Jack have made conflicting statements regarding this. The Principal at Majestic Way has now reworded that teachers are strongly urged to contact in a positive way.

V. New Business

1. Special Ed Meeting---5 min—Susan Sakaguchi Concerns shared—Itinerant LSH stretched; RSP has large number of students with huge range of grades and abilities

Autism at Morrill— special ed students not counted and general ed teachers are having mainstreamed students on top of full amount of general ed students

NEA/RA Local and State on March 31-April 2

Ballot materials will be distributed week of March 17th

Campaigning is March 17th -20th

  1. Noble (Pamela Thomassen)à 4/5 teachers get prep day for conferences, but the DO limits what days they can get subs. Request that the district not plan activities which require subs at the same time Action: Joyce will discuss with Jack/Marc
  2. Cherrywood (Peter Davis)àMotion made that Rep Council authorize $5 per member for site reps to spend on treats. Approved unanimously Follow-up: Reps buy the treats and submit receipt for prompt reimbursement to treasurer, Julie Zlatunich (Brooktree) Day of the Teacher is May 6th.
  3. Sierramont MS (Dave Pousho)à Concern regarding student seen as potentially volatile and the request of an elective teacher that he not be scheduled to be in Home Ec class for Trimester 3 where he would have access to cutlery. Request to have him rescheduled to another elective. SMS administrators had not yet taken preventive action. Action: Joyce will talk to Jack.
  4. Majestic Way (Sandra Main)à Site administrator has issued a letter to teachers stating that they must make an effort to conference with EVERY parent (by phone if not in person) and to make 2 positive contacts. This goes beyond contract language and it is attempt to carry out yet to be finalized grading policy. This also is happening at Toyon and Vinci Park. Action: Joyce and Elem. Reps will talk to Majestic Way, Vinci Park and Toyon administrators and will raise it in meeting with Marc Liebman.

IV. Old Business

Urgent: : Non-reelect Notices being given to Temporary and Probationary Members

Dear Rep:

Joyce Singh has asked me to email you to let you know that the district has already started to give non-reelect notes to temporary and probationary (non-tenured) teachers.

Please let your members who are Probationary and Temporary know that we urge them to contact Joyce Singh immediately if they have any questions or concerns.

Later this week, prior to the March 15th deadline, the district will be giving the notices of tentative assignment for 2008-09 to all members who are continuing. Some members may also be getting RIF (Reduction In Force) notices, based on seniority and the BUSD Board of Trustees approved number of 78.

Obviously, these are important matters and we REALLY need all sites to be represented at the CTAB Rep Council on Tuesday March 11th.

Please encourage members to carefully review the seniority list they recieved on email from Mayra last week to check for accuracy.

NEA Local Delegate Election

Dear Reps,

We need to correct the dates for the NEA RA Local Delegate Election, due to the fact that the scheduled date of the voting is during Spring Break vacation. The Elections Committee was just passing on what they had been given and fortunately a sharp-eyed Rep saw the date conflict.

Please post this REVISED time line on your CTAB board at your site.

CTAB will be voting for Local Delegates for the NEA Representative Assembly between


March 31 and April 2.
